KHERSON, APRIL, 21ST, 2008, CONTEXT-PRICHERNOMORIE — Ministry of transport and communication of Ukraine, state enterprise «Kherson sea trading port», Austrian company «Allgemeіne Beteіlіgungsverwaltungs-und Handels Gmb», private enterprise «Kherson sea terminal» and also the primary trade-union organization of the Kherson sea trading port have signed the memorandum on April, 16th, 2008, on settlement of all issues arisen owing to disputable economic contracts signed before, “Context-Prichernomorie” correspondent reports.

The agency was informed about this today by the assistant to the chief of port on information questions and publishing house Miron Buba.

As he stated, the final point in dispute was se by common will of all parties. The debate lasted more than 2 years and was considered by different judicial instances under claims of the trade-union organization of the Kherson sea trading port, and also the State Office of Public Prosecutor of Ukraine.

As they say in the message, initiators of claims considered that positions of the contract allowed legal assignation of port property to the foreign company on conditions which contradicted interests of the state enterprise and broke a parity of property interests of the contract parties as the port should have received a smaller part of profit (40 %), having enclosed all available property and money resources in the general activity.

The parties have committed to take all measures on the fastest termination of all proceedings, returning of property and refusal of any mutual claims during 5 days from the date of memorandum signing.

As participants of the memorandum have specified the signing of it became possible only owing to active assistance of Minister of transport and communication of Ukraine Joseph Vinsky who has taken the decision of this question under the personal control and managed to convince all the parties of necessity to settle all disputable legal issues by the conclusion agreement of lawsuit as soon as possible.
