Port of Yuzhny: the verdict in the conflict with TIS to be carried out by court

ODESA, AUGUST, 28th, 2009, CONTEXT-PRICHERNOMORIE – The press-service of Commercial Sea Port of Yuzhny stated the managing board of the Transinvetservice Company made a number of statements at a press-conference, which are not in accord with reality in the conflict between the port and the company, Context-Prichernomorie correspondent reports.

The agency was informed about it today 28 August at the press-service of Commercial Sea Port of Yuzhny.

“We would like to remind, the actions of the port’s administration concerning the fact of the Port’s of Yuzhny refusal to include berths No 22 and 23 belonging to TIS Ltd. into the Obligatory Regulations of the Port and mooring M/V Tarns Oceanic to Berth No 21had been inspected by the Black Sea Transport Prosecutor’s Office. In compliance with the results of this inspection 18.08.2009 a decision was made to refuse the company in initiating a criminal case against G.E. Commercial Sea Port of Yuzhny. The ground for such a decision was no corpus delicti in the case”, — they informed at the press-service.

They also added the Ministry of Transport and Communications of Ukraine had also expressed their position concerning this case: 14.08.2009 deputy Minister of Transport and Communications of Ukraine, Chief of State Sea and River Transport Administration Mikhail Chubay stated the Trensinvestservice Company would be able to commission Berth No 21 in G.E. Commercial Sea Port of Yuzhny only after having passed through all the obligatory procedures provided by the acting rules.

“There are rules providing certain procedures of endorsement of the commissioning of berths. The list of these regulations is quite concrete. The company’s representatives have disregarded these regulations”, — Mr. Chubay said.

INFORMATION: The Commercial Sea Port of Yuzhny is situated in the North-West area of the Black Sea, on the ice-free Adzhalykskiy Liman and is a cargo operation turnover leader (20 million 698 thousand 600 tons in 2005). Main transportation directions: the Black Sea and the Mediterranean basins, the USA, Latin America, Middle East, South-Eastern Asia. All cargo, storage and auxiliary operations are carried out in the port. There work specialized complexes in the port for operation of mineral fertilizers, liquid chemicals, export overload berths for general and bulk cargoes.

Transivestservice (TIS) is Ukraine’s largest terminal for bulk cargoes and is a transit gate to a greater part of south-east Russia and neighbour countries. It has a strategic location in relation to the Ukrainian hinterland. It is situated at the Adzhalykskiy Liman- 40 km south from the City of Odesa. The terminal is the gateway to the World market of 450 million consumers of grains, fertilizers, coals, ores, etc. More than 50 scheduled services link TIS with over 1000 ports worldwide. The company’s throughput in 2005 amounted to 5,3 million tones. TIS is situated directly on the Black Sea. It is the deepest terminal of Ukraine, so the largest ocean-going vessels have unrestricted access around the clock, seven days a week. The port has a depth of 14 metres (47 feet) and never freezes. The terminal is most famous for rapid turnaround times. A lot of auxiliary services are provided too Due to the size of the operations, the terminal offers significant advantages of scale. TIS is investing all the time to attract new cargoes, expand and improve its service.
